JAMMU, Sept 16: Even as a court declared 13 Pakistan-based terrorists as proclaimed offenders clearing decks for attachment of their assets after 30 days in Kishtwar, the Government of India has also completed formalities for approaching Interpol and writing Letter Rogatory to Pakistan for extradition of 36 terrorists of Kishtwar operating from Pakistan and PoJK as top commanders of various outfits.

Official sources confirmed to the Excelsior that the Ministry of Home Affairs has completed all formalities for Letter Rogatory to Pakistan seeking extradition of the militants and approaching Interpol for their arrest.
“The process will be completed very soon. The exercise is in the final stage,” they said, adding police have mentioned full details of 36 terrorists including their areas of operation in Pakistan and PoJK.
Most of them were commanders of Lashkar-e-Toiba (LeT), Jaish-e-Mohammed (JeM) and Hizbul Mujahideen militant outfits.
As per the inputs available with police, out of 36 militants of Kishtwar operating from Pakistan and PoJK, only 14-16 are active while rest have been engaged in manual work and have married local girls to settle there.
Police sources said the process to attach properties of 13 terrorists will start after 30 days.
“We have identified houses, shops etc of the militants. However, since the court has given time of 30 days to militants to appear before it, the attachment exercise will be undertaken after court directions and completion of legal formalities,” the officials said.
Entire exercise is being conducted under the close supervision of SSP Kishtwar Khalil Poswal and DySP Special Investigating Unit (SIU) Kishtwar Vishal Sharma.
However, only part of the property which will be legal share of the militant in the house of his parents will be attached, they clarified.
Thirteen terrorists of Kishtwar whose assets will be attached include Shahnawaz Kanth alias Munna alias Umer son of Abdul Rasheed Kanth of Hullar, Nayeem Ahmed alias Amir/Gazi son of Ghulam Nabi Gundna R/o Near Jamia Masjid, Mohammad Iqbal alias Bilal son of Mohammad Akber Butt of Kichloo Market, Shahnawaz alias Nayeem son of Ghulam Mohammad of Chirool Padyarna, Javid Hussain Giri alias Muzamil son of Mohammad Amin Giri of Kundali Pochal, Bashir Ahmed Mughal son of Ghulam Qadir Mughal of Jugna Keshwan, Gazi-ud-Din son of Mohammad Ayoub Gujjar of Jugna Balna, Keshwan, Sattar Din alias Rajab alias Saifullah son of Mehar Din Gujjar of Jugan Keshwan, Imtiyaz Ahmed alias Dawood son of Aziz Mohd Sheikh of Banderna, Shabir Ahmed son of Ghulam Mohi-ud-Din of Jawalpur Bonjwah, Mohammad Rafiq Keen son of Bashir Ahmed Keen of patnazi Bonjwah, Muzaffar Ahmed son of Abdul Ahmed Dev of Semna Colony Zewar and Azad Hussain son of Abdul Majeed, a resident of Affani Padder.
Earlier in the day, a court declared 13 Pakistan-based terrorists as proclaimed offenders in Kishtwar district, paving the way for attachment of their properties if they fail to appear before it within 30 days.
The proclamation notice under Section 82 of the Code of Criminal Procedure (CrPC) was served to the families of the terrorists in different parts of Kishtwar by the Special Investigation Units (SIUs) of the local police amid beating of drums, they added.
A total of 13 local terrorists, who are operating from across the border and making repeated attempts to revive terrorism in the district, were declared as proclaimed offenders after they failed to respond to the non-bailable warrants issued earlier.
The warrants were issued by the special NIA court in March in a terror-related case registered at the Kishtwar police station last year under various Sections of the Indian Penal Code and Unlawful Activities (Prevention) Act.
“If these proclaimed offenders fail to surrender within 30 days, the proceedings to attach their properties under Section 83 of the CrPC will be initiated,” the officials said.
In the proclamation notices served to the absconding terrorists at their birth places, Additional District and Sessions Judge (fast-track court) Doda Sudesh Sharma said the warrants of arrest issued by the court of Additional Sessions Judge, Jammu were returned with the report that the accused could not be found.
“It has been shown to my satisfaction that the said accused has absconded or is concealing himself to avoid the service of the said warrant. Proclamation is hereby made that the accused is required to appear before this court within the period of 30 days from the date of publication of proclamation, failing which proceedings under Section 83, CrPC shall be launched against him,” the identical notices issued on Thursday read.
