Constitute SIT for speedy probe into killing of 2 youths: HC

 

Srinagar:  Refusing to grant more time for concluding the investigation into the killing of two youths allegedly in security force firing in 2010, High Court directed Inspector General (IG) of police, Kashmir range, to constitute a Special Investigation Team (SIT) within a week to carry forward probe.

Perusal of the orders passed by this Court from time to time reveal that the concern of the Court has not been registered by the Government seriously, the court said, adding that instead, the respondents have sought time for concluding the investigation.

This court has already granted sufficient time, a single bench of the High Court comprising Justice Ali Mohammad Magrey said.

He directed the IG Police to constitute the SIT to be headed by an officer not below the rank of Senior Superintendent of Police (SSP) within a week to ensure investigation in the right direction and submit the report of investigation within four weeks.

The court sought comprehensive report from the SIT by the next date of hearing.

It also directed SSP Anantnag to monitor the probe  himself.

Two youths Bilal Ahmad Najar and Noorul Amin Dagga were allegedly killed in security force firing in September 2010 when they were waiting outside a mosque at Khanabal to offer ‘Nimaz Jinazah’ of another student Maroof Ahmad Nath, who was drowned in river Jehlum after security forces allegedly chased him and others in the area.

Justice Maagray also asked the investigating authority to examine and consider the list of witnesses provided by the petitioner for recording their statements under law.

The Court passed the order after hearing Advocate Mian Abdul Qayoom representing the victims’ families and Additional Advocate General M A Chashoo defending the State in the case.

Mian Qayoom submitted that the Court directions passed from time to time have not been implemented in letter and spirit by the State and the SSP has never monitored the case  himself.

However, Chashoo pleaded that there was no intentional delay on part of the investigating authority. (AGENCIES)
