JAMMU, Aug 29: Division Bench of the State High Court comprising Justice Alok Aradhe and Justice B S Walia has directed Commissioner/ Secretary PWD, Chief Engineer PWD and Chief Executive Officer (CEO) Economic Reconstruction Agency (ERA) to complete the repair/blacktopping of the New Plot-Janipur road including approach road to High Court within six weeks from today.
The direction was passed while disposing of Public Interest Litigation (PIL) filed by a practicing lawyer Irtiza Mushtaq. The Division Bench also directed that the authorities shall file a status report before the Registrar Judicial regarding the completion of the macadamisation of the road and in case the status report is not filed then the petitioner will be at liberty to seek revival of the Public Interest Litigation.
Earlier, when the PIL came up for hearing, Advocate Sheikh Shakeel Ahmed with Advocates Rahul Raina, Suraj Singh and Supriya Chouhan submitted that after the intervention of the State High Court the ERA/PWD has macadamized a portion of the New Plot-Janipur road but a major portion of the road requires macadamisation.
“This is the only approach road for the State High Court and the authorities woke up only when notices were issued by the court on July 27, 2017”, he submitted, adding “just within one week the authorities macadamized a portion of the road and further directions are warranted for completion of the macadamisation work”.
At this stage, AAG L K Moza appearing for the Public Works Department submitted that the remaining work will also be completed without any further loss of time and sought six weeks time to complete the macadamisation of the road.
After considering the submissions of both the sides, the Division Bench, in the open court, disposed off the Public Interest Litigation by directing the Commissioner/Secretary PWD, Chief Engineer PWD and Chief Executive Officer Economic Reconstruction Agency (ERA) to complete the repair/blacktopping of the New Plot-Janipur road including approach road to J&K High Court within six weeks from today.
