CJM Reasi frames charges in forgery, cheating case

JAMMU, Aug 29: Chief Judicial Magistrate (CJM) Reasi Archana Charak today framed charges in challan produced by Police Station Reasi against accused Mohd Rafiq, son of Mohd Din of Dalyoth, Thakrakote in forgery and cheating case.
As per the prosecution case, a complaint was lodged by DySP Headquarters Reasi Nikhil Gogna to the effect that accused who is a constable got sanctioned PCL Loan worth Rs 5 lakh and Rs 7 lakh in the year 2016 and 2017 by using fake stamp and signature of SP Reasi and deposited confirmation letter and salary certificate in the J&K Bank Branch DC Office, Reasi.
Accused Mohd Rafiq used fake signature and stamp of SSP Reasi thrice and made duplicate documents for the personal benefits and got sanctioned loan in his favour. Upon this application, FIR was registered at Police Station Reasi and investigation in the case started.
The counsel for the accused Advocate Rakeshjeet Singh argued that Investigating Officer seized photocopy of cash book which is not admissible in law. According to the prosecution story, accused used fake stamp of SSP Reasi but in chargesheet they did not even mention that investigating agency tried to recover stamp from the accused.
Further the counsel for accused also placed on record the copy of application filed by alleged accused for providing salary certificates for PCL from J&K Bank dated 04-02-2016, copy of application to Brach Manager, J&K Bank DC Office, Reasi for issuance of NOC dated 03-10-2017.
Ashwani Kumar, Additional Public Prosecutor Reasi appearing on behalf of UT of J&K effectively argued that there is sufficient material on record which connects the accused with the commission of offence as alleged to be committed by the accused as such accused be charged and prosecution is allowed to produce the evidence.
“After going through the initial complaint filed by complainant, contents of FIRc Challan, statement recorded by IO under Section 161 CrPC, FSL Report, it appears that prima facie accused has committed offences, therefore, accused as such liable to be charged for the offences under Sections 419/420/467/468/471/201 RPC”, the court said.
