JAMMU, Oct 18: Chief Judicial Magistrate (CJM) Jammu, S R Gandhi has ordered a thorough investigation through Crime Branch in misappropriation of Rs 45 lakh by Hindu Education Society Kashmir (HESK) Executive Body.
The order was passed by the court on the complaint of Avtar Krishan Dewani & Others versus Anil Dhar and others here today filed by P N Goja, senior advocate.
While passing the orders the judge observed that the case is of public importance and needs thorough investigation through Crime Branch. Maintaining that serious allegations of dishonest misappropriation of Rs 45 lakh on the part of potential accused persons have been made, the Court sent the complaint to Crime Branch, Jammu with the direction to I/C to verify the allegations. It also gave directives to investigating agency that in case of cognizable offence appears to have been committed, the FIR be registered and investigation conducted under law. The Court has also asked the IC, Crime Branch to compliance.
The complainants in their application had prayed before the Court of CJM that the matter be referred to Crime Branch Jammu for investigation and an inquiry be ordered under Section 156 (3) CrPC or under Section 202 CrPC.
In their complaint Mr Dewani and others alleged that the accused have without approval of the Executive Body of the society have withdrawn and misappropriated Rs 45 lakh from account of the society lying in Central Bank of India, Talab Tillo Branch Extension Counter and shown to have been advanced to one Dileep Singh, whose particulars are unknown.
They said that on March 24, 2011 Rs 5 lakh were withdrawn from the account number of Hindu Education Society Kashmir (HESK) which is managing the Gandhi College. It was followed by withdrawal of Rs 5 lakh each on April 27, 2011, June 27, 2011, June 28, 2011, June 30 2011 and July 1, 2011. Besides the withdrawal of Rs 30 lakh, Rs 15 lakh have been also withdrawn by the accused within a period of one month.
In the complaint it was further mentioned that the accused had admitted that the amount was paid for effecting the mutation of the purchased land which stands duly recorded in minutes of the meeting of the General Council of the society held on April 13 this year as well as 70th meeting of the Executive Body of the Society when in fact an expenditure of only Rs 24,000 as per the Government rules are incurred for the same purpose.
