JAMMU, Apr 30: Chief Judicial Magistrate (CJM) Jammu Amarjeet Singh Langeh has rejected the bail application of notorious thief, who was arrested by the Janipur Police Station.
“The examination of police report would explicitly reveal that a complaint with regard to theft of car bearing registration No. JK14E-7669 was lodged with police station by the complainant alleging that while car was parked outside the house of complainant at Paloura, someone committed its theft”, the CJM said.
Based on this complaint FIR No. 39/2021 for offence under Section 379 of IPC was registered and investigation started. During investigation, it came to fore that car in question has been seized in Punjab. Investigation further showed that applicant/accused stole car from Paloura on 06.04.2021 and took it to Punjab after changing its name plate and substituting the same by a fake one bearing No. HR01AR1290 where FIR No. 50/2021 stands registered against applicant for offences under Section 379/411 of IPC.
Further, it also surfaced during investigation that applicant/accused was involved in FIR No. 49/2021 for offence under Section 379 of IPC registered with Police Station Bagh-e-Bahu, another FIR No. 46/2020 which is again under Section 379 of IPC with Police Station Crime Branch, New Delhi and yet another FIR No. 31/E with Police Station Delhi.
“Frequency with which applicant has resorted to acts of theft speaks intensity of his determination to resort to theft with impunity and clinical precision in execution thereof much to disdain of public at large”, the CJM said, adding “evidence gathered during investigation demonstrates an astonishing extent of fearlessness that applicant has shown while stealing vehicles and then smuggling them out of UT of J&K via Punjab upto Delhi”.
“Grant of bail to applicant would amount to playing to his strength much to the chagrin of innocent public more particularly when incidents of theft of vehicles have shown an alarming rise in recent times”, the court said while rejecting the bail application.
