CJ frames 2 committees for process re-engineering

JAMMU, Dec 17: On the recommendation of e-Committee, High Court of J&K, Chief Justice M M Kumar has constituted two committees on civil and criminal side for process re-engineering. The committee on civil side is comprised of Justice Muzaffar Hussain Attar and Justice B L Bhat while as committee on criminal side is comprised of Justice Tashi Rabstan, Justice J R Kotwal, Harbans Lal and D K Kapoor former District & Sessions Judges.
Both the committees will work out draft for discussion on process re-engineering under the supervision of Justice Mohammad Yaqoob Mir, Chairperson, e-Committee High Court of J&K.
According to Khalil Choudhary, Central Project Coordinator, e-Courts, process and procedure concerning justice delivery are of great importance both to the litigants and the lawyers. “If the processes and procedures are archaic, there is a possibility of justice delivery being delayed. Keeping this in mind, there is a need to revisit the existing processes and procedures, which were devised and designed years ago and are still being followed in many district courts”.
“There is a need to examine whether due to the passage of time and advancements that have taken place (both technology related and otherwise) court related processes and procedures should be streamlined or not. In addition to modernizing the existing processes and procedures, we need to innovate and introduce new processes and procedures to expedite disposal of cases at the district court level”, he said, adding “the purpose of this document on process re-engineering is to encourage all the district courts to conduct the dual exercise of modernization and innovation so that justice delivery is expedited”.
Khalil Choudhary further said that the objectives behind constitution of committees are to study the existing rules, processes, procedures and forms in vogue in the district courts; modernize the existing rules, processes, procedures and forms to make them litigant friendly and technology related; to introduce new rules, processes, procedures and forms to avoid administrative delays in the district courts; to compile the new rules, processes, procedures and forms and officially publish them for use in the district courts.
He said that process re-engineering may be necessary from the very filing of a case or an application in a case to encompass the whole range of processes and procedures up to making available a certified copy of the final order or decree and consequential steps subsequent thereto.
