JAMMU, Aug 28: After nearly two year of investigations, the Central Bureau of Investigations (CBI) today presented two challans in MBBS/BDS impersonation scam of ASCOMS Sidhra against the beneficiaries, their kin and accused in the court of law.
Former R&B Minister and Congress MLA from Inderwal Ghulam Mohammad Saroori, who had lost his chair in the aftermath of the scam, unearthed by the invigilators and Gandhi Nagar police on August 21, 2010, has not been included in any of the challan.
Similarly, National Conference leader and former Minister Ram Paul’s son Lovish Bharat, who was also one of the beneficiaries of the scam, has not been named in the challan.
While Saroori’s daughter and son figured in the challan, the CBI in any of the challan has named neither Ram Paul nor his son. However, the CBI has clarified that more challans could be presented in due course of time as investigations were still going on.
The beneficiaries, their kin, who had arranged impersonators and paid money and the accused who have been challaned in the case, included Sheetal Gupta daughter of Anjani Gupta, Arshi Kiran and her father Dr Ajit Kumar Choudhary, Dr Kuldeep Singh alias Dr K D Singh son of Gurdial Singh, Pankaj Kumar Priyadarshi son of Ravinder Singh, Kanhaiya Kumar Vats son of Arun Kumar Singh, Kunj Bihari son of Arun Kumar Singh, Rakesh Gupta son of Om Prakash Gupta, Payal Aggarwal alias Shruti Gaur daughter of J L Aggarwal, Huma Tabassum and Muneeb Ahmad, daughter and son of Ghulam Mohammad Saroori, Rattan Lal Sehgal son of Ram Lal Sehgal, Vikas Kumar Paul son of Doodh Nath Paul, Hemant Singh Rajawar son of Umrav Singh Rajawar and Bharat Abrol son of Om Prakash Abrol.
The CBI presented to charge-sheets in the scam in the court of Special Magistrate CBI (CJM) Jammu, Shobha Ram Gandhi after hearing senior Public Prosecutor SK Bhat, appearing for the investigating agency and the counsels of accused. The Magistrate granted bail to all to the tune of Rs 25,000 and committed the case to the Court of Principal Sessions Judge, Jammu.
It was on August 21, 2010 that invigilators of Jammu University and Gandhi Nagar police had detected seven impersonators appearing in the examination of MBBS/BDS of ASCOMS Sidhra for influential candidates. All of them were taken into custody. The investigations had revealed that among six candidates for whom impersonators were sitting in the examinations, two were kin of politicians including Huma Tabassum daughter of the then R&B Minister Ghulam Mohammad Saroori and Lovish Bharat son of NC leader and former Minister Ram Paul.
Within a couple of days, the State Government had handed over the case to the CBI. As Mr Saroori had left for Umrah and didn’t resign, he was removed from the Cabinet. The NC had also suspended Ram Paul from the party.
Sources expressed surprise over the CBI decision to exclude ruling party NC leader Ram Paul’s Lovish Bharat from the challan notwithstanding the CBI’s statement that some more challans could be presented in due course of time.
According to challan, it has been revealed that admission notice of ASCOMS Sidhra for Session 2010 was published on June 9, 2010 under which applications were invited for admission to the 1st year MBBS/BDS course against Management Quota seats for the session 2010. The CET was fixed for July 25, 2010 and later changed to August 21, 2010.
The challan pointed out that Roll No 100024 was allotted to Huma Tabassum D/o GM Saroori. Investigations further revealed that acknowledgment card of Huma was processed/ issued by Ramesh Chander Junior Assistant-cum-Computer Operator in ASCOMS and bears her signatures.
It was further submitted in the challan that accused Muneeb Ahmed S/o GM Saroori and brother of Huma Tabassum in conspiracy with her approached accused Bharat Abrol R/o Channi Himmat Jammu who was his partner in firm M/s Chenab Stone Crushers at Kishtwar for getting a MBBS seat for his sister at ASCOMS Jammu. The original documents i.e. marks-sheet of 10th & 12th of his sister were collected by Bharat Abrol from Muneeb Ahmed and then handed over the same to Rattan Lal Sehgal who was running a consultancy agency in the name and style of Macca Boy Consultancy Patel Nagar Talab Tillo Jammu.
The same documents were finally handed over to accused Dr. Kuldeep Singh, kingpin of the case by Rattan Lal Sehgal, which reached to impersonator Payal Aggarwal alias Shruti Gaur. Investigations further revealed that Bharat Abrol gave Rs 1 lakh in total vide three installments to accused Rattan Lal Sehgal during the months of July/August 2010 for managing MBBS seat at ASCOMS Jammu for Huma on the directions of Muneeb Ahmed.
The CBI in similar circumstances has investigated the role of each and every accused along with the impersonator and filed two comprehensive challans seeking prosecution of the accused.
The CBI has prayed before the court that accused Pankaj Kumar Priyadarshi and Hemant Singh Rajawar may be granted pardon and allowed to be made as approvers in the case under Sections 337 read with Section 338 of J&K CrPC.
