Srinagar, June 12: The Central Administrative Tribunal (CAT) directed the authorities to consider the claim of a migrant-employee for a flat in transit accommodation at Zewan Srinagar.
A bench of M S Latief (J) while considering the plea of a migrant employee-Preya Koul for allotment of a flat in transit accommodation directed the authorities to consider his representation for allotment of flat in tune with the Government order with a period of one month.
“…till the representation is decided, in case there is a flat available and the applicant is otherwise entitled to in terms of the Govt Order dated: 4.7.2024, the same shall be reserved for her”, the bench directed.
Koul pleaded that excluding her name from the allotment list of transit accommodation is totally arbitrary and discriminatory and contrary to the scheme of Prime Minister’s package for return and rehabilitation of Kashmiri Migrants to the valley.
Koul has been appointed as Jr. Assistant under the Prime Minister’s Special Package scheme for Kashmiri migrants and was ordered to report to the office of Kashmir Power Distribution Corporation at Srinagar.
She pleaded that the Government issued a criteria for allotment of quarters to the employees appointed under PM’s package and in terms of the said order, locations and district along with number of flats are approved and earmarked as such she applied for seeking her accommodation in terms of Government order.
The bench while allowing her plea said the right of shelter is a fundamental right coupled with the fact that the Government formulated a criteria for such employees appointed under the PM’s package.
