JAMMU, Oct 19: Prof Bhim Singh, Senior Executive Member, Supreme Court Bar Association, today presented a strong appeal to the Chairman, Bar Council of India in New Delhi, urging for the extension/application of Bar Council of India Act in respect of all the advocates in J&K where this Act has not been applied till this date.
A Division Bench of the Supreme Court of India, headed by Chief Justice of India, Tirath Singh Thakur, had directed the High Court of J&K to hold elections for the Bar Council of J&K in its judgement on October 12, 2017. The petition was filed by Prof Bhim Singh. This judgment of the Supreme Court had not been implemented by the J&K High Court till day.
In his letter, addressed to Chairman of Bar Council of India, Prof Bhim Singh requested for his immediate intervention to ensure that Bar Council of India is extended to J&K without any delay so that Advocates in J&K shall also share the fruits of equality before the law. “I have been agitating this issue for the past 48 years without any response either from the Govt of India or from the Bar Council of India. This Act on the part of the Govt of India or Bar Council of India amounts to discrimination with the entire lawyers’ fraternity of J&K,” he added.
“Let the so-called Bar Council of J&K be replaced by an elected Bar Council for constitutional integration of J&K with the rest of the country. The steps must be taken to hold elections in accordance with the Advocates Act (as amended) for the Bar Council of J&K,” Bhim Singh writes in his letter.
