JAMMU, Aug 10: City Judge Jammu Prem Sagar has rejected the bail application of Shokat Ali, son of Nazir Ahmed from whose possession heroin was recovered by Bagh-e-Bahu Police.
After hearing Senior PO Raj Kumar for the State, the court observed, “statements of material witnesses are yet to be examined/recorded and the source of the narcotic seized is yet to be ascertained. Moreover, investigation of the case is at initial stage”.
“Though the offence committed by the accused person is bailable in nature but its impact on the society at large is very detrimental particularly for the youngsters who are falling easy prey to the drug traffickers who allure them and selling of narcotics is creating havoc in society”, the court said, adding “though bail is a rule and jail is an exception but the duty of the court is paramount particularly when the offences are under NDPS Act and court must exercise the discretion of bail judicially”.
With these observations, court rejected the bail application.
