Bail denied to woman OGW of HM outfit

SRINAGAR, July 12: Special Judge (Designated Court under NIA) Anantnag Khalil Ahmad Choudhary has rejected bail application of a woman Over Ground Worker (OGW) of Hizbul Mujahideen outfit.
The applicant namely Naseema, wife of Ab Salam Shiekh of Rampora Qaimoh in Kulgam district was arrested and booked under different sections of Unlawful Activities (Prevention) Act in the year 2018 after it came to the fore that she was not only providing shelter to the militants but also taking arms and ammunition from one place to another. Her photographs with arms were also appearing on social media.
After hearing counsel for the applicant/accused and Additional Public Prosecutor, the Special Judge observed, “perusal of the case diary would show and satisfy the court that there are reasonable grounds to believe that the allegations/acquisitions leveled against the accused are prima facie credible and plausible and that the investigating agency is in the process of collecting further evidence to scan and analyze the involvement of the accused in the commission of the crime imputed to her”.
“The applicant/accused is seeking bail on the ground of her innocence and false implication in the present case besides her ill health. As per allegation leveled against her, she along with other accused indulged into rioting and instigated the youth for raising slogans against the integrity of the county”, the court further said, adding “statements of some witnesses are yet to be recorded and charge-sheet is yet to be presented”.
The court further said, “investigation of the case is in progress and granting of bail to the applicant/accused will definitely thwart the process of investigation”, adding “the ground agitated by the counsel seems to be devoid of any merit and is not deemed to be ground for grant of bail”.
“Whether accused is involved in the commission of offences or not is a matter of trial and cannot be gone at this stage. As per CD file and evidence collected so far by the IO prima face involves the applicant/accused. The evidence recorded by the IO can be weighed after the charge-sheet is filed before court”, the Judge said, adding “in case applicant/accused is released on bail there is every apprehension of tampering with the prosecution evidence”.
While rejecting the bail application, the court directed the respondents to provide better treatment to the accused/applicant after consulting the concerned specialist.
