JAMMU, Aug 2: Presiding Officer Fast Track Court Jammu Khalil Choudhary has denied bail to a person who has been booked by Domana Police for committing rape.
The accused Ajay Khajuria, son of Subash Chander of Lower Muthi was booked by Domana Police under Section 376 IPC on the basis of a complaint relating to committing of heinous crime of rape.
After hearing counsel for the applicant and Additional Public Prosecutor for the UT, the Presiding Officer of the Fast Track Court observed, “perusal of the police report and statement of the prosecutrix recorded under Section 164 CrPC would show and satisfy the court that there are reasonable grounds to believe that the allegations leveled against the accused are prima-facie credible and plausible”.
“The counsel for the petitioner has taken the plea that the allegation against the applicant/ accused is baseless and no incriminating evidence has been collected by the Investigating Officer against the petitioner as such he deserved concession of bail. But, after perusal of the police report and statement of the prosecutrix recorded under Section 164 CrPC, it is clear that there are materials establishing the involvement of the accused in the commission of offence”, the court observed.
“The investigation is at initial stage and charge-sheet is yet to be produced before the court and the accused/petitioner is still absconding. So granting of anticipatory bail will definitely thwart the process of investigation”, the court further said, adding “the evidence recorded by the IO can be weighed after the completion of the investigation against the accused person”.
“At this stage, applicant/ accused person is involved in heinous offence under Section 376 RPC and in case he is released on bail there is every apprehension of tempering with the prosecution evidence”, the Presiding Officer said while rejecting the bail application.
