SRINAGAR, Aug 24: Special Judge (Designated Court under NIA) Anantnag Khalil Ahmad Choudhary has denied bail to active member of Jaish-e-Mohammad (JeM), who has been booked under Unlawful Activities (Prevention) Act for instigating youth to join anti-national activities.
The accused Rafie Shafi, son of Mohammed Shafi Naikoo of Shopian was arrested by Police Station Imam Sahib under Sections 18, 39 and 40 of Unlawful Activities Prevention Act and 3/25 Arms Act on May 11, 2020 after it came to the fore during the course of investigation that he was active member of the militants and was involved in heinous offence against the sovereignty and integrity of the country by instigating the youth for joining antinational activities.
After hearing Additional Public Prosecutor and counsel for the accused/applicant, the court observed, “perusal of police report reveals that applicant/accused was allegedly providing assistance to the militants by way of money”, adding “his release will amount to increase and development of militant organizations as the country most particularly UT of J&K has already been in the firm grip of spiralling terrorist violence and is caught between deadly pangs of disruptive activities”.
“Terrorism is an evil affecting the life and liberty of peace loving people. Terrorism has no barriers, it may strike anybody anytime, any amount of precautionary measures and security arraignments may prove futile to combat terrorism”, the court said, adding “fundamental rights to individual liberty is certainly valuable. But when it is pitted against the life and liberty of the people at large, it becomes insignificant”.
The Judge said, “on over all analysis of the matter in its totality, I am of the considered opinion that applicant/accused has failed to establish a reasonable and cogent ground for grant of bail at this stage and as such there appears to be no merit and substance in the bail application of the applicant/accuse”.
Accordingly, court rejected the bail application.
