JAMMU, July 4: City Judge Jammu Manjit Rai has rejected the bail application of one Nand Kumar in abetment to suicide case.
According to the police case, on 04.06.2022 information was received that one lady namely Sangeeta Bharti, wife of Nand Kumar of Chattishgarh, at present near Jaswant Plaza, Jammu who was admitted in GMC as burn case, died. In her statement, which was recorded earlier, she stated that she was burnt by her husband.
After hearing APP Arvind Rathore for the UT, the court observed, “the accused is alleged to have committed the offence under Section 306 IPC which is non-bailable and serious in nature, as such, the accused cannot claim bail as a matter of right”.
“It cannot be overlooked the fact that this type of offence under 306 IPC is at great increase and causing alarm to the public at large. The offence is not against individual but is against society at large. The accused/applicant does not deserve any leniency in grant of bail. There is also apprehension that if the accused/applicant released on bail, he will try to win over the prosecution witnesses and tamper with the prosecution evidence”, the court said.
