JAMMU, June 29: Ist Additional Sessions Judge Jammu M A Chowdhary has rejected the bail applications of three persons, who were allegedly involved in smuggling of heroin.
These accused persons are Mumtaz Ahmed, son of Shokat Ali, Mohd Shabir, son of Mohd Sharief and Liaqat Ali, son of Mohd Qasim, all the residents of Mendhar. They were arrested by Nawabad Police on September 17, 2016 along with heroin.
After hearing APP Ajay Singh Manhas, court observed, “to decide the matter of bail under NDPS cases quantity of contraband is important. The heroin recovered from the possession of accused falls within commercial quantity”.
“In view of the commercial quantity of the seized contraband, rigor of Section 37 of NDPS Act is attracted which provides that the court can grant bail to the accused/applicants only on satisfaction that the accused have not committed the offence”, Additional Sessions Judge said while rejecting the bail application.
