Bail denied to drug peddlers

POONCH, Feb 10: Sessions Court Poonch today rejected the bail applications of four drug-peddlers, who were booked under Narcotics Drugs and Psychotropic Substances Act.
As per the police report, all the four smugglers were nabbed with charas and heroin. They were pushing youth of the area in the cobweb of this menace.
After going through the reply filed by the Public Prosecutor and the police report, Principal District and Sessions Judge Poonch Tahir Khurshid Raina rejected all the bail applications by a common order.
“The fundamental object behind NDPS Act and that of Section 37 of the Act is to check this menace to the hilt which has eaten the very vitals of the society”, the court said, adding “many young people of the area have fallen prey to the menace who may not die instantly by consumption of contraband but of course they die daily which is more painful for parents and society”.
“The gravity of the offence is serious and all the stakeholders of the society have to move in tandem in curbing the menace”, Principal District and Sessions Judge said, adding “courts too can’t afford to remain mute spectators in this lofty endeavor”.
“The court further observed, “giving bail to accused at this nascent stage of investigation will amount to putting blow on investigation and will encourage the perpetrators of this crime”, adding “though the  contraband recovered is even below of smaller quantity but Section 37 of  NDPS Act has made all offences under this Act non-bailable”.
“Moreover, the general conditions of the bail like gravity of the offence and its impact on the society are quite applicable and on the touchstone of  these conditions the facts of the case totally warrants rejection of all such bail applications”, the court said while rejecting the bail applications.
