Arrest warrant against Khan, 16 others

JAMMU, Aug 9: In the much publicized Indian Air Force personnel killing case of 1990, Presiding Officer TADA Court Jammu Subash Gupta today issued general arrest warrants against JKLF chief Amanullah Khan, Javed Mir, Dr Ghulam Qadir and Abdul Rehman Dar.
The court also issued general arrest warrants against Riyaz Bhat, Khursheed Ahmed Dar, Basharat alias Bitta Karate, Tareeq Ashraf, Shafat Ahmad, Manzoor Ahmed, Abdul Majid Bhat, Nissar Ahmed, Mohd Yaqoob, MS Halima, Javed Iqbal Mir, Mohd Yaqoob Pandit and Gh. Mohd Taploo in Rubiya Syed kidnapping case.
The general arrest warrants were issued by the Presiding Officer after hearing Special PP- S K Bhat, ALA/CBI/HQ, New Delhi along with PP-CBI- Vijay Kumar Dogra, who sought issuance of warrants against whom proceedings in terms of Provision of Section 512 of Code of Criminal Procedure have been initiated vide interim order dated September 17, 1991.
“It is reported that despite order dated 17.9.1991, due to oversight,  warrants have not been issued for the arrest of the accused  against whom  proceedings in terms of Provisions of Section 512 of Code of Criminal Procedure have been initiated”, the court observed and accepted the prayer of CBI.
“The CBI has also filed the report relating to execution of warrants issued for the production of the accused- Yaseen Malik before the court. It appears that on 7.8.2019  the  production warrants issued against the accused -Yaseen Malik by this court was received  by the  I/C Dak Section, Central Jail, Tihar , New Delhi . It is the contention of the CBI that due to  small time gap  between the production warrants received and production of the accused, he would have not been produced by the jail authority before this court”, the Presiding Officer observed, adding “their prayer for issuance of fresh warrants for production of accused– Yaseen Malik is accepted”.
Accordingly, it was ordered that fresh warrants shall be issued for the production of the accused -Yaseen Malik, on next date of hearing positively. “Warrants, so issued shall be forwarded to Superintendent  of Central Jail, Tihar through head of the branch CBI/ ACB, Jammu, for execution”, the court ordered.
