Amendment in Recruitment Rules to have prospective effect: Govt

JAMMU, Mar 14: State Government today clarified that amendment in the Gazetted and Subordinate Services Recruitment Rules will have prospective effect.
As per the circular issued by the General Administration Department, in terms of SRO-438 dated December 11, 2015, an amendment in the Gazetted and Subordinate Service Recruitment Rules was carried out by incorporating a provision for conducting written test by the selection agencies for selection against all the advertized posts.
In consultation with the Department of Law, Justice and Parliamentary Affairs, the GAD said, “the SRO-438 dated December 11, 2015 will be applicable to the selections made after issuance of this notification and the selection process already initiated before issuance of this notification is to be conducted as per rules in vogue before the issuance of notification SRO-438 of 2015”.
The GAD further said, “every law, rule, notification or order is effective prospectively unless there is an express provision for applying the same retrospectively”, adding “in other words, retrospective operation has to be expressly provided. Notification SRO-438 of 2015 shall have a prospective effect”.
The GAD has directed all the concerned agencies to follow the opinion of the Department of Law, Justice and Parliamentary Affairs.
It is pertinent to mention here that the GAD decided to obtain opinion of the Law Department keeping in view the confusion prevailing at the level of not only selection agencies but the applicants for various posts also.
