This is in reference to the news item published under the caption, “Governor takes serious cognizance of allegations against JU VC” in your esteemed paper on 12th Oct 2017. The committee constituted by the Registrar following an official communiqué GS-60(JU)2017/4809-2017 of the Governor’s Secretariat has serious flaw as all the committee members are subservient to the incumbent VC.
As per the administrative instructions issued vide Govt. of India C.S. Deptt. of Personnel O.M. dated 7.12.70-Exts (A) Dated 6th Jan, 1971 published and printed under GOI decision No. 10 under Rule 14 of CCS (CCA) Rules, published in Swamys’ 1993 edition at page 47, the only requirement is that the “inquiries should be conducted by an officer who is sufficiently senior to the officer whose conduct is being inquired into, as inquiry by a junior officer cannot command confidence which it deserves.”
In the interest of justice, all the members of the enquiry committee must be senior to the incumbent VC which, in other words means that the enquiry committee must comprise of the members from outside Jammu University.
