JAMMU, May 2: Sanjeev Gupta, Presiding Officer Fast Track Court constituted for the hearing of cases of crime against women, today acquitted accused in rape of minor girl as prosecution failed to produce the prosecutrix and her father.
According to police case, on May 19, 2011 a girl aged about 13 years was raped by the accused namely Abdul Wais. Accordingly, police registered a case and statements of the prosecutrix and her father were recorded under Section 164-A CrPC before the Magistrate. After completion of investigation challan was presented in the court of law.
After hearing Advocates Ghara Kumar and Sahil Gupta appearing for the accused whereas Additional Public Prosecutor for the State, Presiding Officer Fast Track Court observed, “so far as material prosecution witnesses, father of prosecutrix and prosecutrix are concerned, their whereabouts could not be located at Narwal Bala where they were putting-up temporarily”.
“The statements of SHO Trikuta Nagar Inspector Chanchal Singh and searching constable Mohd Yousaf were recorded in which both of them have stated that despite their best efforts no clue about the whereabouts of the persons was found. It appears that prosecution witness, who hails from Burma (now called Myanmar), was putting-up temporarily along with family at Narwal Bala”, the court said, adding “in these circumstances, the prospects of locating the whereabouts of father and prosecutrix had become bleak. In absence of any material against the accused, he is acquitted of the charges leveled against him.
