Accused facing trial in setting ablaze kullah acquitted

JAMMU, Mar 2: Principal Sessions Judge Samba Kartar Singh has acquitted one Narinder Kumar, son of Subash Chander of Samba, who was facing trial for setting ablaze a kullah.
According to the prosecution case, on June 30, 2007 a complaint was submitted to the Sub-Judge, JMIC Samba mentioning that on the intervening night of June 13-14, 2007 the accused trespassed into the residential house of Ram Lal (complainant) and set his kullah on fire.
The JMIC forwarded the complaint to the SHO Police Station for necessary action under the provisions of Section 156 (3) CrPC. Accordingly, police registered case under Section 436 and after completion of investigation submitted final report.
After hearing both the sides, Principal Sessions Judge Samba Kartar Singh observed, “it has come in the statement of prosecution witnesses that complainant and the family of the accused are having enmity with each other and the possibility of false implication cannot be ruled out”.
“It would have been ruled out had the independent witnesses been examined in this case but except the complainant no other witness has supported the prosecution case”, the court said, adding “the prosecution has miserably filed to prove its case against the accused beyond any reasonable shadow of doubt”.
With these observations, Court acquitted the accused of the charges framed against him.
