JAMMU, Sept 14: After finding the material on record failing to disclose the commission of offences under sections 376/511 IPC, the Fast Track Court Jammu discharged the accused person of these charges.
The Court with Presiding Officer, Khalil Choudhary further ordered that the accused Mohd. Kesh son of Sher Ali resident of Sunjwan, Chatta, Jammu should be charged for the commission of offences under sections 452/323/354 IPC.
As per the case, Police Station Channi Himmat registered an FIR no. 20/2022 under section 376/511/452/323/354 IPC after a lady complained that her former husband Mohd. Kesh, who was inimical with her, entered her house in Sunjwan with criminal intentions when she was all alone and he beat her, tore her clothes, snatched her gold chain, injured and molested her. She further stated that to save herself she raised an alarm and some people came and rescued her.
After listening arguments of both sides, the Judge (Presiding Officer) at Fast Track Court Jammu stated that none of the offences disclosed is triable exclusively by the Court of Sessions and he transferred the charge-sheet to the Court of Chief Judicial Magistrate (CJM) Jammu for framing of charge against the accused and proceed further in the matter in accordance with the law.
The Judge also said that the file shall come up before the transferee court on September 19, 2022 and directed the accused to remain present accordingly.
