Court awards 2 year imprisonment to accused in molestation case

KATHUA, Oct 30: Judicial Magistrate, First Class, Billawar, R.K.Tadyal today awarded two years imprisonment and fine of Rs. 4500 to Abdul Gani, son of Taj Din of Dharalta tehsil, Billawar, district, Kathua facing trial in a case of assault or outraging the modesty of a woman.
Brief facts of the case are that on October 31, 2012 at 08:30pm complainant /victim namely Morni Devi, wife of Man Singh furnished an application in Urdu at P/S Billawar along with her mother in law for lodging FIR against the accused.
In her complaint, she said that on October 30, 2012 at about 11pm accused namely Abdul Gani entered in her room with criminal intention to outrage her modesty and pressed her mouth as soon as he entered in the room and broken her cord of Salwar without her consent. She cried and screamed but he did not loose his grip over her .On hearing the noise her mother in law came and on seeing her mother in law the accused ran away from spot. Her clothes were torn out and no house was situated near to her residence. Then in the morning she informed this incident to her husband through telephone and whole day she waited for her husband due to which lodging of FIR was delayed.
On her complaint FIR U/S 341/354/457 RPC was registered in Police Station Billawar and investigation commenced. After completion of investigation challan was presented in the court of Ld. JMIC Billawar. After hearing P.O. Ch Asif Iqbal appearing for the State and Ld. Counsel for the accused observed that the prosecution has proved his case beyond reasonable doubt and evidence of eye witnesses has also corroborated other evidence. The accused is proved to be guilty and liable to be convicted.
The Court awarded simple imprisonment of two years and fine of Rs.4500 for commission of offence U/S 354/457,341/ RPC.
