Court directs police to register FIR against bank employee

JAMMU, Apr 10: In the alleged malpractice during demonetization by SBI employee namely Pawan Kumar Mahajan of Pathankot, Chief Judicial Magistrate Kathua Amarjeet Singh Langeh today directed SHO Police Station Kathua to register FIR.
In the application seeking registration of FIR filed by SBI Manager Radhika Nayyar, it has been stated that during demonetization, Pawan Kumar Mahajan performed illegal and unlawful acts by depositing and withdrawing amount from account of different account holders by forging requisite documents and withdrawal/deposit forms.
“The accused credited certain amount into the accounts of certain bank customers without their knowledge and consent and thereafter used to withdraw the same by tampering with requisite documents and accounts of innocent customers”, the complaint said, adding “the accused did not spare even an old lady namely Rattno Devi, who complained that on 21.11.2016, she deposited an amount of Rs 8,000 in her account and when she sought withdrawal of the same, only Rs 4,000/- was paid to her”
After perusal of the complaint, CJM observed, “apart from having terribly shocking impact on the confidence that public at large and customers in particular repose in a banking institution like complainant bank, the allegations against accused have a criminal aspect also”, adding “the sequence of events pen-pictured in the complaint prima facie show commission of offence of cheating, forgery, forgery for the purpose of cheating and illegal appropriation of the money that account holders deposited with the complainant bank”.
“Having regard to the totality of the circumstances and in the wake of allegations against accused which seem to be prima facie credible, it is imperative to direct investigation as postulated under Section 156(3) of Code of Criminal Procedure”, the CJM said while forwarding the complaint in original to SHO Police Station Kathua with the direction to forthwith register the FIR against accused and proceed with thorough and serious investigation in accordance with law.
