JAMMU, Dec 8: Chief Judicial Magistrate (CJM), Ramban Yahaya Firdoos Ahangar has expressed displeasure over the investigation being conducted by a Special Investigation Team (SIT) headed by Additional SP Ramban in the fire incident at Dalwas—base camp of Chenani-Nashri Tunnel on December 31, 2015 in which 10 labourers lost their lives.
While considering the bail application moved by some labourers, who were apprehended by the SIT in the case, the Chief Judicial Magistrate, after hearing Advocate Z A Lone appearing for the applicants/accused and Chief Prosecuting Officer K K Bandral along with Inspector Daljeet Singh (IO of the case), expressed deep concern over shielding of the real accused and delay in completion of the investigation.
“When the case diaries were again called and perused this court does not find any concrete steps taken by the IO after the passing of the order dated 03.12.2016 and the IO has maintained status quo in the investigation”, the CJM said, adding “the case diaries reveal that IO has received all the opinions from the forensic laboratory and has also recorded the statement of witnesses under Section 161 CrPC but the court could not understand as to why there is delay for presenting the final chargesheet”.
While lambasting the SIT over the delay in the matter, the CJM further observed, “on the previous hearing, the court had observed that the occurrence has occurred almost one year back and the victims are yet to get the justice and the defaulters are yet to be booked”.
“The court would not hesitate in making the observation that all this has happened only because of snail’s pace investigation by the SIT. It is hoped that SIT would produce the chargesheet in near future as the court does not find anything to be investigated further and the same has also been admitted by the IO Daljeet Singh except that the statement of one injured witness is yet to be recorded”, CJM said.
While parting with the matter, the CJM directed that CPO shall produce the case diaries along with IO and Chairman SIT on next date of hearing in order to apprise the court about the latest stage of investigation and fixed the matter on December 29.
