JAMMU, May 23: Special Judge NIA, Kishore Kumar today framed charges against Pakistani militant Naved and five others, who had carried out attack on the BSF convoy on August 5, 2015 at Narsoo on Jammu-Srinagar National Highway in Udhampur district.
In the militants attack, some BSF personnel lost their lives and several others sustained injuries. In retaliation, one terrorist was killed and the other terrorist namely Mohd Naveed, a Pak national and a trained terrorist of the LeT (Lashkar-e-Toiba), was arrested.
During the course of investigation, it came to the fore that after receiving training in various LeT camps located in Pakistan and Pakistan occupied Kashmir (PoK), Mohd. Naveed along with three other LeT terrorists, namely Mohammed Bhai, Abu Noman and Abu Okasha illegally crossed the Line of Control (LoC) from Pakistan in the first week of June 2015 with the object of waging war against the Government of India by committing terrorist acts in India.
LeT terrorists based in South Kashmir and led by Abu Qasim hatched a conspiracy to commit a terrorist act by targeting a security camp near Jammu on or around the July 10, 2015. Pursuant to the conspiracy, Mohd Naveed and Abu Okasha travelled Jammu area in order to execute the same. However, the conspiracy could not be consummated due to a change in plans on the part of terrorists.
During NIA probe, it further came to the fore that Mohd Naveed was recruited to the LeT in a local mosque through a person named Bashir Moulvi, a resident of Faisalabad, Pakistan in the year 2011. Bashir Moulvi further referred Mohd Naveed to one Abdullah Sultan, an employee of ‘Markaz Khyber’, Nishat Abad, Faisalabad, Pakistan. Abdullah Sultan facilitated Naveed’s journey for the LeT sponsored trainings. In all, Naveed attended three training camps organized by the LeT at different places.
On June 2, 2015, a group of four LeT terrorists, namely, Mohd Naveed, Mohammed Bhai, Abu Noman and Abu Okasha crossed the LoC from near ‘Fajja Top’ (PoK) and ‘Noori Post’. Thereafter, Mohammed Bhai and Abu Noman guided the group in the direction of Baba Reshi in district Baramulla using grid references and GPS sets were provided to them by LeT handlers in ‘Halen Det’.
Mohammed Bhai and Abu Noman informed the group that they had to reach a pre-determined tree near Baba Reshi where they would meet the receiving party. A cloth tied to the pre-determined tree would signal the arrival of the receiving party. Following the directions with the aid of GPS devices, the group reached the point of the pre-determined tree on or around June 7, 2015.
The arrangements for the reception of the infiltrating group of terrorists were made by Abu Qasim, the self-styled commander of LeT in South Kashmir. At the time of the infiltration of Mohd Naveed, Mohammed Bhai, Abu Noman and Abu Okasha, Abu Qasim was staying in his hideout at Khadermoh, district Pulwama. Another, LeT terrorist, Aashiq Hussein Bhat, was also staying with Abu Qasim, who contacted Showkat Ahmed Bhat, a tipper driver and supporter of LeT on or around May 31, 2015. He asked Showkat Ahmed to transport Aashiq Hussein Bhat to Baba Reshi in his tipper bearing registration number JK13A 5376 in order to receive the infiltrating party.
Accordingly as per strategy, the infiltrating party of terrorists was received at the pre-determined tree and then transported to Awanpora. On July 7, Abu Qasim entered into a conspiracy with Mohd Naveed, Abu Okasha, Khursheed Ahmad Bhat, a supporter of the LeT, to commit a terrorist act on a security camp near Jammu. Khursheed Ahmad Bhat was asked to transport Mohd Naveed and Abu Okasha, who were given arms and ammunition, to Jammu area with a direction to drop them near a security force camp in order to give effect to the conspiracy.
Accordingly, Khursheed Ahmad Bhat along with one Nisar Ahmed Parray, son of Abdul Jabbar of Chursoo, Awantipora, Mohd Naveed and Abu Okasha left for Jammu in truck with registration number JK 13B 7225 on July 7, 2015. The party reached Jammu on the night of July 9, 2015. However, due to last minute changes in plan, the conspiracy to commit the terrorist act did not fructify.
The conspiracy to attack the security forces convoy in Jammu area was hatched in the house of Fayaz Ahmad Ittoo on or around the August 2, 2015. At that time, a group of terrorists including Abu Qasim, Adil Shergujri, Majid Zargar, Moin Kachroo, Maaz and Mohd Naveed were present in the house of Fayaz Ahmad Ittoo. During the meeting, the details of the conspiracy to attack a security force convoy in Jammu province were discussed and Abu Qasim directed Khursheed Ahmed to arrange a truck for the purpose of transporting the terrorists for the intended attack. Further, Khursheed Ahmed was directed by Abu Qasim to escort the terrorists in his private car to the point of attack in order to afford them safe passage on the Srinagar-Jammu National Highway.
On August 3, Abu Qasim and Majid Zargar left the residence of Fayaz Ahmad Ittoo and returned at about 1330 hrs on August 4, 2015 along with Abu Noman and a truck bearing registration number JK03C 7778. The truck was also accompanied by Khursheed Ahmad Ittoo, who arrived at Fayaz’s house in Maruti Alto car bearing registration number JK03A 8929. The truck JK 03C 7778 was driven by Fayaz Ahmad Ashwar and Shabzar Ahmad Bhat was helper in the truck. Once the terrorists had loaded their arms, ammunition and explosives (which were then in a gunny bag) in the truck, accused persons namely Mohd Naveed ,Abu Noman , Fayaz Ahmad Ashwar @ Setha and Shabzar Ahmad Bhat sat out in the truck from Khudwani, district Kulgam, J&K towards Jammu.
After going through challan produced by NIA, Special Judge NIA Kishore Kumar observed, “the court is of the considered view that there are sufficient grounds to presume that this is a case for trial and if any defense as projected by the counsel for the accused that has to be determined during trial”, adding “there is sufficient material on record for framing charge against the accused persons”.
Accordingly, Mohd Naveed has been charged for the commission of offences under Sections 121, 121-A, 122, 302, 307, 333, 364, 435 r/w 120-B, 115, and 34 of RPC, Sections 16,18,20 of Unlawful Activities (Prevention) Act, 7/25 and 7/27 of Arms Act, Section 3B and 4 of Explosive Substance Act and 14-A Foreigners Act, Section 325, 326, 342 RPC, Section 38 of Unlawful Activities (Prevention) Act.
Khursheed Ahmed Bhat has been charged for the commission of offences under Sections 120B, 121, 115 RPC, Section 18 and 39 of Unlawful Activities (Prevention) Act, 14-C of Foreigners Act and 7/25 of Arms Act while as Showkat Ahmed Bhat has been charge sheeted for the commission of offences under Sections 120B- 121, 121-A RPC, Section 18 and 39 of Unlawful Activities (Prevention ) Act, 14-C of Foreigners Act and 7/25 of Arms Act.
Shabzar Ahmed Bhat has been charged for the commission of offences under Sections under Sections 121, 121-A, 122, 302, 307, 333, 435 read with Section 120-B and 109 RPC, Section 18 and 39 of Unlawful Activities (Prevention) Act, 7/25 of Arms Act and Section 14-C of Foreigners Act while as Fayaz Ahmed Ittoo charged for the commission of offences under Sections 121, 121-A, 122, 302, 307, 333, 435 read with Section 120-B, 109 of RPC, Section 18, 19, 39 of Unlawful Activities (Prevention ) Act, 7/25 Arms Act and 14C of Foreigners Act.
Khursheed Ahmed Ittoo has been charged for the commission of offences under Sections 121, 121-A, 122, 302, 307, 333, 435 read with Section 120-B and 109 of RPC, Section 18 and 39 of Unlawful Activities (Prevention) Act and Section 14-C of Foreigners Act.
