Jammu, Dec 27: Under the guidance and patronage of Chief Patron of State Judicial Academy, Justice N. Paul Vasanthakumar, Chief Justice, High Court of Jammu and Kashmir and Committee of Judges, State Judicial Academy (Justice Muzaffar Hussain Attar, Chairman, Justice Hasnain Massodi, Member and Justice Janak Raj Kotwal, Member), Jammu and Kashmir State Judicial Academy today conducted one day “Mediation Training programme for Referral Judges” for District and Sessions Judges, Sub-Judges and Munsiffs of Districts of Jammu, Samba, Kathua, Udhampur, Reasi, Rajouri and Poonch.
Justice Mohammad Yaqoob Mir, Judge, High Court of Jammu and Kashmir and Chairman, Mediation and Conciliation Committee inaugurated the training programme.
The proceedings were conducted by Abdul Rashid Malik, Director, J&K State Judicial Academy.
In his key note address, Justice Mohammad Yaqoob Mir highlighted the background and statutory mandate of Alternative Dispute Resolution (ADR) mechanism contemplated by Section 89 which includes arbitration, conciliation, judicial settlement including settlement through Lok Adalats and Mediation. He said that it has now become imperative to resort to ADR mechanism with a view to end litigation between the parties at an early date. Justice Mir said that it is voluntary and confidential process by which through the intervention of a person called Mediator who is a neutral and impartial person, the parties are helped to come to voluntary and mutually acceptable resolution of their disputes.
Dinesh Kumar Sharma, Director (Academics) Delhi Judicial Academy who was the Resource person for the programme masterly gave power point presentation on Dispute Adjudication to Dispute Resolution and highlighted components with special reference to Right of Self-Determination, role of Mediators, benefit of mediation and Role and Responsibility of Referral Judges whereby he demonstrated characteristics in detail of Pre-Mediation stages to Post Mediation stages.
The programme was concluded with vote of thanks by the Director, State Judicial Academy who expressed his gratitude to Hon’ble Mr. Justice Mohammad Yaqoob Mir, visiting Resource person and participants and hoped that the programme might be beneficial for the judicial officers especially to make co-ordinated efforts to achieve the ultimate goal of expeditious disposal and justice to the aggrieved parties.
