5 yrs RI to militant in kidnapping, torture case

JAMMU, Dec 8: Principal Sessions Judge Bhaderwah Sanjeev Gupta today awarded five years rigorous imprisonment to Abdul Gani, son of Ali Mohd Butt of Thathri, an active militant, who kidnapped proseuctrix.
According to the prosecution case, on 16.06.2004 Mohd Ibrahim and Maryem Begum were kidnapped by the accused at gun point in order to commit their murder. He took them in a forest area where they were mercilessly beaten up.
After the registration of FIR, the police started search of the victims and accordingly a police team recovered prosecutrix in an injured condition from ‘Mihand Dhar’. However, no clue with regard to the whereabouts of another person was found. However, the second victim was also recovered on 09.08.2004 in an injured condition from the temporary shed of Nawab Din and Lal Din situated at ‘Mashod Dhar’.
After the completion of investigation, the complicity of the accused in the crime was established and challan was presented in the court of law.
After hearing Public Prosecutor Manju Sharma for the State whereas Advocate RK Gupta for the accused person, Principal Sessions Judge observed, “convict is sentenced to undergo rigorous imprisonment for a period of five years under Section 364 RPC with a fine of Rs 3000. He is further convicted under Section 325 RPC and sentenced to undergo rigorous imprisonment for a period of three years with a fine of Rs 3000”.
Under Sections 323 & 324 RPC, the convict was sentenced to undergo rigorous imprisonment for a period of one year. In default in payment of fine amounting to Rs 6000 he shall undergo simple imprisonment for a period of 15 days each which shall run concurrently, the court said.
