JAMMU, Oct 15: In the mysterious disappearance of 12 year old child, High Court today directed Director General of Police to constitute a Special Investigation Team (SIT) comprising of Superintendent of Police, SDPO and the concerned Station House Officer, who shall be supervised by Inspector General of Police, Jammu.
High Court further directed that the exercise with regard to constitution of SIT shall be undertaken by October 19.
The 12 years old boy namely Vishal Sharma, son of Rajesh Sharma of Vijaypur went missing on May 5, 2014 when he went out of his home while playing with a pet belonging to his neighbour Satish Kumar.
After hearing Advocate Sheikh Shakeel Ahmed, Deputy AG Faraz Iqbal appearing for SSP Samba, SDPO Vijaypur and SHO P/S Vijaypur and Advocate Monika Kohli appearing for CBI, Justice Ali Mohammad Magrey directed the DGP to constitute Special Investigation Team, which shall immediately put all the mechanism in operation and make an endeavour to trace out the missing boy.
“The SIT shall file status report by October 29 and on this date the Superintendent of Police heading the SIT shall appear in person along with CD file”, the High Court directed.
Justice Magrey also expressed displeasure over the non-serious approach of the Vijaypur Police in tracing the minor and observed, “perusal of the record reveals that there is no material placed by the State with reference to make an endeavour to put their all mechanism in operation for tracing the missing boy or locating his whereabouts”.
“Failure on the part of the State to fulfill its constitutional and legal obligation with reference to tracing out the missing boy shall form a ground for assigning the case to Premier Investigating Agency”, the High Court said.
