Raze constructions coming up without proper permission: HC

JAMMU, Dec 11: Division Bench of State High Court comprising Chief Justice M M Kumar and Justice Tashi Rabstan today directed Jammu Municipal Corporation and Jammu Development Authority to raze all the fresh constructions, which are coming up without seeking permission from the concerned authorities.
The direction was passed in a letter written by Amit Dalia, a social activist highlighting the menace of illegal constructions in Jammu city and blatant violations of Master Plan. This letter has been treated as Public Interest Litigation by the High Court.
After hearing Advocate Parag Sharma and Senior Advocate R K Gupta, Amicus, the DB observed, “large scale violations in the use of residential area particularly in Gandhi Nagar have been brought to our notice”, adding “JDA has filed a list highlighting the violations. These violations involve use of residential areas into the commercial without seeking any permission from the local bodies”.
“As a resultant effect, the residents of the areas are unable to live in peace and tranquility. They are facing parking problems and the area is unnecessarily congested”, the DB said and directed the JDA and JMC to proceed with action with regard to razing of fresh constructions which might be in progress.
“JDA and JMC shall be entitled to seal the buildings if such a fresh construction is found to be in progress on the spot. If there is any obstruction in discharging of their official duties then IGP Jammu shall provide them police help”, the DB directed.
