JAMMU, Nov 17: In a Public Interest Litigation (PIL) filed by Bar Association Jammu and Sumit Nayyar seeking various development activities around court complex, Division Bench of High Court comprising Chief Justice MM Kumar and Justice Tashi Rabstan today issued various directions.
After hearing both the sides in length, DB observed, “detail report has been filed and Senior Advocate AV Gupta has made an additional alternate suggestion to visit the site, which is necessary for new road”.
“In respect of lawyers’ chamber, Senior Advocate D C Raina has pointed out that total amount released by the project authority so far is Rs 908 lakh and the value of the work executed at the site as on October 2014 is Rs 1115.20 lakh and this shows that more than Rs 2 crore is outstanding”, the DB said.
In the status report filed by Department of Law, Justice and Parliamentary Affairs, it has been stated that after the release of second installment of Rs 54 lakh, the balance amount of the project-Rs 108 lakh is to be released. After 100 per cent authorization is conveyed by the Planning and Development Department, then the amount could be released. There is nothing on the record to suggest that after 5th of September, 2014 the Planning and Development Department has authorized to release all the balance amount or not, the DB further observed.
On this, Division Bench directed Senior AAG Gagan Basotra to file the status report before the next date of hearing. “Status report with regard to direction issued concerning the parking and de-congestion of traffic in the High Court as well as District Court Complex shall also be filed before the next date of hearing”, the DB directed.
