JAMMU, Sept 9: The much publicized Public Interest Litigation regarding illegal constructions in the Khads today took new turn when an application was filed by one Kali Dass seeking impleadment as party.
In the application, Kali Dass mentioned that despite clear cut directions by the High Court regarding ban on sale and construction on Khad, the Jammu Development Authority has invited applications for allotments of plots in three colonies namely Gole Gujral Housing Colony, Roop Nagar Housing Colony, Kot Bhalwal Housing Colony and the Birpur Housing Colony.
“The perusal of the advertisement dated July 15, 2014 clearly shows that the proposed sites are adjoining to the nallahs and bank of River Tawi. Moreover, the revenue record of the Bhalwal and Birpur clearly shows that the nature of the land is Gair Mumkin Khad”, the applicant said.
After hearing Advocate Abhinav Sharma for the PIL whereas Advocate Amit Gupta for the applicant Kali Dass, DB comprising Justice Virender Singh and Justice Tashi Rabstan arrayed JDA as party respondent and issued notice through Vice-Chairperson/Secretary returnable within week.
