Benefit of backward area/ALC likely to be extended to Kashmiri migrants

JAMMU, June 10: State Cabinet, which is meeting under the chairmanship of Chief Minister, Omar Abdullah at Civil Secretariat, Srinagar tomorrow afternoon, is likely to give nod to the recasting of Jammu and Kashmir Reservation Rules in order to extend the benefit of backward area/area near Actual Line of Control (ALC) to the Kashmiri migrants.
Authoritative sources told EXCELSIOR that in the recent past Divisional Commissioner, Kashmir forwarded the case of some migrant applicants of Budgam district to the General Administration Department for issuance of backward area certificate in their favour on the ground that these applicants are basically residents of tehsil Chadoora and after abandoning their homes during the year 1997, they are presently putting up in Migrant Colony at Sheikhpora due to the security reasons.
He even quoted an extract of Rule 29 from SRO-126 of 1994 regarding issuance of RBA certificates to the persons belonging to a declared backward area but having migrated within the Valley in secured zones on security reasons.
Accordingly, the General Administration Department asked the Social Welfare Department to examine the issue and take further action of bringing Rule 21 (iii) of SRO-294 of 2005 (presently in vogue) in the line with the Rules, which were in operation from 1994 to 2005 so that the Kashmiri migrants continue to get the benefit of reservation by virtue of their being the residents of backward area/area adjoining the Actual Line of Control.
“After examining the case in the light of SRO-294 of 2005 and the repealed rules-SRO-126 of 1995, the Social Welfare Department has observed that the reason for entitling the Kashmiri migrants to the benefit of being a resident of an identified backward area/area near the Actual Line of Control, despite the fact that they are not living in such identified areas, was that the migration is a temporary event and these migrants would return to the Valley as soon as the circumstances become conducive”, sources said, adding “the Social Welfare Department has suggested that Kashmiri migrants should continue to get this benefit despite the fact that they are not presently living there”.
“In order to extend the benefit of being a resident of a backward area/area near ALC in favour of those Kashmiri migrants, who have migrated to different parts of the State for security reasons and are living within the State, an amendment is required in the Rule 21(iii) of the J&K Reservation Rules, 2005”, sources said, adding “as the Department of Law, Justice and Parliamentary Affairs has vetted the proposal of the Social Welfare Department in this regard, Cabinet is likely to clear the proposal tomorrow”.
Sources disclosed that Cabinet will accord sanction to the creation of State Project Directorate and Technical Support Group under Rashtriya Uchachatar Shiksha Abhiyan (RUSA) Scheme of the Union Ministry of Human Resource and Development.
“The creation of Directorate and Group is imperative to receive grants from the HRD Ministry under RUSA Scheme”, sources said.
The Cabinet will also discusses and approve other routine administrative agenda submitted by different departments, they further said.
