JAMMU, Mar 6: Division Bench of High Court comprising Justice Virender Singh and Justice Janak Raj Kotwal today upheld the death penalty to Vijay Kumar of Akhnoor, who had committed murder of three innocent children of his brother.
According to the prosecution case, on September 20, 2000 the accused killed three children of his brother namely Arjun, Parkash and Santosh Kumari and seriously injured his brother Jia Lal, Bhabhi Kamlesh Kumari and their fourth child Ghulshan.
During the course of investigation, it came to fore that accused Vijay Kumar, who had entered into wed-lock with Sudesh Kumari, sister of his Bhabhi Kamlesh Kumari, used to beat his wife oftenly and this was objected to by Kamlesh Kumari and Jia Lal a number of times. Due to this, the relations between accused and the victim turned estranged. The accused decided to kill Jia Lal and his entire family after parents of Sudesh Kumari refused to send her back to the house of accused keeping in view the torture being meted to her.
After completion of investigation, police presented challan in the court of law under Sections 302, 307, 325, 323, 324, 326 and 448 RPC. On November 16, 2009, the then 2nd Additional Sessions Judge Jammu V C Koul awarded death sentence to the accused and against that order accused filed present appeal.
After hearing Senior Advocate Surinder Kour with Advocate Rajiv Gorka for the accused, Division Bench of High Court comprising Justice Virender Singh and Justice Janak Raj Kotwal observed, “the present case falls within the category of rarest of rare cases and the brutal act of the accused warrants nothing short of death sentence”.
With these observations, DB upheld the death sentence as already awarded by the Trial Court.
