JAMMU, Jan 13: Principal Sessions Judge Jammu Kartar Singh acquitted Tanveer Hussain Bukhari, son of Muneer Hussain of Pakistan as prosecution failed to prove its case.
The Pakistan national was arrested on March 28, 2011 by Thanamandi Police Station under Section 3 of EAO. During the course of investigation, it came to fore that Tanveer Hussain got training in militancy related activities in the year 2002 and thereafter he crossed the border and entered into this country along with group of militants and remained busy in militancy.
After hearing Public Prosecutor for the State whereas Advocate Sheikh Zulfiqar Ali for the accused, Principal Sessions Judge Jammu observed, “the prosecution has examined five witnesses whose statements have been discussed but not even a single witness has connected him with the commission of the alleged offence”, adding “they have categorically stated that the accused is the son of Hakim Shah, who went missing when he was child and later on he surrendered before the Army and faced trial in the court at Rajouri where he was acquitted”.
“The only evidence assembled by the prosecution during trial of the case is the interrogation report which has connected the accused with the commission of the alleged offence. Except interrogation report, there is not even an iota of incriminating evidence against him”, the court said, adding “the interrogation report is inadmissible in evidence and cannot be read against the accused”.
With these observations, Court acquitted the accused of the charges leveled against him.
