SC suspends HC judgment on Rs 30 cr penalty to companies

SRINAGAR, Jan 7:  A division bench of the Supreme Court today suspended by four weeks, the operation of the Jammu and Kashmir High Court order of imposing a penalty of Rs 30 crore on three food products manufacturing companies whose products were found adulterated and unsafe for human consumption.
The companies had approached the apex court of the country pleading that the High Court passed the order without hearing them and sought its suspension.
A division bench of the Apex court today ordered suspension of the High Court order by four weeks and companies have been allowed to plead their case before the High Court in next hearing which is on January 27.
The Apex court requested the High Court to go through the petitioners’ plea and pass appropriate orders.
A division bench of the High Court comprising Justice Muzaffar Hussain Attar and Justice Tashi Rabstan had passed the order of imposing penalty on three food products manufacturing companies on December 23, after studying the reports of Central Food Laboratory Kolkata that had declared Khyber Milk manufactured by Khyber Agro Farms, turmeric powder manufactured by AVON Agro Industries Pvt Ltd Delhi and Saunf powder manufactured by M/s Kanwal Agro Food Industries Anantnag not fit for human consumption for being health hazards.
The Court had directed the three companies to deposit Rs 10 crore each with the Director SKIMS, Soura, Srinagar ordered him to keep the amount in a separate account and wait for the further orders from the court for its utilization.
