JAMMU, Dec 16: 3rd Additional Sessions Judge Sanjeev Gupta today awarded 12 years rigorous imprisonment and fine of Rs 27000 to Sunil Kumar, who facing trial in a case involving kidnapping and rape of a minor girl.
According to the police case, on September 1, 2004 father of the prosecutrix lodged a report that on August 28, 2004 his 14 years old daughter left the home to attend her school but she did not turn back. He alleged that the accused enticed her daughter and took her to unknown place.
On this, police registered a case under Section 363 RPC. During the investigation police succeeded in recovering the prosecutrix and after medical check up Section 376 was added.
After hearing APP GS Charak for the State whereas Senior Advocate Surinder Kour for the accused person, 3rd Additional Sessions Judge observed, “rape is heinous crime, a crime against the society and also human dignity”.
Accordingly, the Court awarded seven years rigorous imprisonment under Section 376 RPC and five years rigorous imprisonment under Section 363 besides fine of Rs 25000. Court, however, clarified that both the sentences shall run concurrently.
“If the fine amount is realized from the convict the same shall be paid to the victim as compensation”, the Court directed.
