Srinagar, May 17: High Court today directed the Fee Fixation Committee (FFC) to pass the orders with regard to the hike in tuition fee in a private school in accordance with rules after taking all the stakeholders into confidence.
The division bench of Justice Ali Mohammad Magrey and Justice Puneet Gupta decided the plea by directing the FFC to consider the matter in accordance with the rules notified on May 10 and pass the final orders with regard to the hike in tuition fee proposed by the Delhi Public School, Srinagar most expeditiously. Court also directed the FFC to pass such orders after hearing all the stakeholders.
“In the event, the petitioner-school still has any grievance upon passing of final order by the FFC it shall be at liberty to approach the appropriate forum for seeking redressal of the same in accordance with law”, DB said.
These directions followed after the attention of the court was invited to the Rules notified by the Government on the subject in terms of SO No. 233 dated May 10, 2022, whereby the Jammu and Kashmir Private Schools (Fixation, Determination and Regulation of Fee) Rules, 2022 have been framed. The petitioner Counsel Hakim Suhail submitted that one of the grounds on which the Orders of FFC issued on February 18 and November 1 last year were challenged before the court as these orders were issued in absence of any rules on the subject.
He pleaded that now that the rules have been notified by the Government, FFC has to exercise powers in tune with the mandate of the rules so framed for the purpose and the court directed the Committee to proceed further in the matter and pass the final order in terms of the aforesaid Rules and after hearing all the stakeholders.
The counsel appearing for Government also conceded before the court these facts and submitted that the Committee shall have no difficulty to pass the final order in the matter strictly in accordance with the mandate of the aforesaid rules framed by the Government on the subject.
