Corruption charges framed against EO LAWDA

SRINAGAR, Mar 15: Special Judge Anticorruption Srinagar has framed charges against Shah Skinder Khan, Enforcement Officer Lakes and Waterways Development Authority (LAWDA) in illegal construction case.
According to the Anti-Corruption Bureau, the accused during his posting as Enforcement Officer LAWDA from 03.02.2014 to 01.05.2015, in complete disregard to his official position and in pursuance to the conspiracy with other accused permitted raising of illegal construction of a double storied concrete tin roofed house at Ishber Nishat without requisite permission from competent authority.
Moreover, he slept over the information of his subordinate enforcement staff with regard to illegal construction with effect from 20.09.2014 to 31.12.2015. The accused being criminally silent about the matter compelled Supervisor concerned to directly inform the then VC LAWDA, who took cognizance and ordered demolition on 27th & 28th of September, 2014.
The Special Public Prosecutor submitted that statement of witnesses recorded during investigation prima facie leads to concrete conclusion that accused paved the way for the illegal construction in furtherance of criminal conspiracy for symbiotic interest as such offences under Prevention of Corruption Act and Section 120-B RPC were established against him.
After hearing both the sides, the court said, “it is crystal clear that evidence collected against the accused during investigation leads to definite conclusion that there are reasonable grounds for believing that accused have committed the offences as indicated in the FIR”, adding “the accused is charged for the commission of the offences under Prevention of Corruption Act”.
