JAMMU, May 11: Presiding Officer Fast Track Court Jammu, Sanjeev Gupta today directed SSP Jammu to cause personal appearance on next date of hearing and explain why proceedings for disobeying the court directions be not initiated against him in the gang rape case.
In the case titled State versus Jeet Raj and Others under Section 376/34 RPC, the Court vide order dated March 30, 2013 had sent warrant of arrest of accused to SSP Jammu for execution with the direction to constitute a special team to arrest the accused and produce in the court.
However, the warrant of arrest could not be executed and received back with the report that whereabouts of accused Jeet Raj were not found despite efforts. Again on April 23, 2013 a warrant of arrest was issued against accused and sent to SSP through Additional Public Prosecutor on the same terms. However, the warrant of arrest was not received back in the court thereby indicating that sincere efforts were not made by SSP Jammu to execute the warrant, the Presiding Officer observed after hearing APP G S Charak.
“It appears prima-facie that SSP Jammu has deliberately failed to comply with the direction of the court which amounts to disobeying the order”, 2nd Additional Sessions Judge (Fast Track Court) said, adding “the SSP Jammu is, therefore, directed to cause personal appearance on the next date and show cause as to why proceedings for disobeying the court directions be not initiated against him”.
The next date in the case is May 21, 2013.
