JAMMU, Apr 29: State High Court has stayed the Government order regarding migration of MBBS students from Government Medical College, Srinagar to Government Medical College, Jammu and vice-versa.
The Government order was stayed in a writ petition filed by Ayushi Sharma, a MBBS student of Government Medical College, Srinagar.
Senior Advocate Sunil Sethi along with Advocate Vikas Razdan appearing for the petitioner submitted that the petitioner and private respondent namely Raahil Farooq Shah, 2nd year MBBS student of Government Medical College, Jammu, jointly moved an application for migration from Government Medical College Srinagar to Government Medical College Jammu and vice-versa and the application was duly processed by the Commissioner Secretary, ARI and Trainings Department after collecting No Objection Certificates from all the concerned.
“While according sanction for migration, the case of the petitioner was not considered sympathetically because of some obvious consideration and rejected mechanically without assigning any little, legal or other justification when the fact remains that the case of the petitioner is on better footing”, the counsels for the petitioner said.
After hearing counsels for the petitioner, Justice Bansi Lal Bhat issued notice returnable within four weeks and in the meanwhile stayed the impugned order No.11-TRGS of 2013 dated April 25, 2013 till next date of hearing—May 24, 2013.
