Mian Qayoom likely to be released in Aug

Srinagar, July 27 The Kashmir Bar Association president Mian Abdul Qayoom is likely to be released in August as the Centre today informed Supreme Court that his detention under Public Safety Act won’t be extended.
The information was provided by Solicitor General (SG)Tushar Mehta to three judge bench comprising Justice Sanjay Kishan Kaul, Justice Ajay Rastogi and Justice Aniruddha Bose while hearing a Special Leave Petition (SLP) filed by Qayoom challenging the judgments of Single Bench and Division Bench of J&K High Court.
The Supreme Court with these submission made by the SG deferred the hearing of the case till Wednesday for seeking instruction from SG in this regard and observed that why the detenue-Qayoom may not be released immediately with pre condition that he will not leave Delhi till August 7. Court on July 13 had directed the SG to look into the matter pertaining to the detention of Qayoom in view of COVID-19 and apprise the court on next date.
Single Bench of High Court on 7.2.2020 had dismissed the petition of Qayoom and had upheld the detention passed against him which he challenged before the Division Bench of High Court and the division bench while dismissing the appeal of Qayoom had left it open for the Government to consider his release if any application is made for releasing him of parole in view of his health conditions.
Qayoom was detained on August 7 last year under detention order dated DMS/PSA/105/2019 passed by district magistrate Srinagar with a view to prevent him from acting in any manner prejudicial to the maintenance of public order.
His first litigation was dismissed with the conclusion that the matter lies within the competence of Advisory Board and the court does not sit in appeal over decision of detaining authority and cannot substitute its own opinion over that of detaining authority when grounds of detention are precise and proximate.
