JAMMU, Oct 14: Father-son and their servant were among six persons awarded life imprisonment for their involvement in the murder cases.
Abdul Rashid, son of Ahsan Wani of Dachnoo, his son Sajjad Ahmad Wani and their servant Mohd Rafiq Takkar, son of Juma Takkar of Rajouri presently putting up in Heerpora Shopian had murdered Imam and Mousin of Jamia Masjid namely Mohd Yasin Wani in the year 2007.
The motive behind the murder was to grab the property of the deceased. The murder led to large-scale public protests and demonstrations.
After hearing Public Prosecutor Imtiyaz Ahmed Khan for the State whereas Advocates Mohi-ud-Din Perwaiz and Moulvi Shabir Ahmed for the accused persons, Principal Sessions Judge Shopian, Raja Shujat Ali Khan today observed, “the authoritative precedents relating to the subject guide me to the opinion that the case in hand is not rarest of the rare case and convicts do not deserve capital punishment as envisaged under Section 302 RPC”.
Accordingly, Court awarded rigorous life-imprisonment to all the three accused.
In another murder case, Principal Sessions Judge Bhaderwah, M K Sharma has awarded life-imprisonment to Davinder Singh, son of Krishan Lal Lohar, Khadim Hussain, son of Mohd Ismail Gujjar of and Sumitra Devi, widow of Puran Singh, all the residents of Gandoh.
According to the police case, Sumitra Devi was having illicit relations with Devinder Singh and on the night of October 27, 2002 she along with her paramour and one Mohd Ismail killed Pawan Singh at his residence by breaking his neck.
While awarding life imprisonment, Principal Sessions Judge Bhaderwah observed, “this is a case of murder of a husband by his own wife with the assistance of co-convicts. There is nothing so uncommon about this crime to deem it as exceptional case in which instead of life imprisonment, death sentence could be awarded”.
“Though a young person has lost life in the instant case by his own wife and paramour but it does not fall in the category of rarest of rear cases where the death sentence is warranted”, the Court observed.
