5 yrs imprisonment awarded to two in stabbing case

BHADERWAH, May 2: Additional Sessions Judge awarded five years imprisonment and Rs 20,000 fine to two persons, who were found involved in stabbing case.
As per official spokesman, on December 26, 2006, Gurmail Singh was stabbed in his abdomen with the scissors by two persons namely Aflesh Kumar, son of Faroz Chand of Panoo, at present Prem Nagar and Rishi Kumar, son of Swami Raj of Gatha Tehsil Bhaderwah, causing him grave injures.
On this, a case under FIR Number 52/2006 under Sections 307, 326, 323, 504 and 34 RPC was registered at Police Station Thathri and investigation was entrusted to PSI Ashwani Kumar of Police Post Prem Nagar.
During the course of investigation, the investigating officer visited the spot, prepared site plan, recorded the statements of witnesses under Section 161 CrPC as well as collected the circumstantial evidences relating to the instant case.
Finally offence under Sections 307, 326, 323, 504 and 34 RPC was fully established against both the accused.
After the investigation completed, the challan of the instant case was produced in the court of law for judicial determination.
After a long trail of 11 years, the Court, which examined the witnesses of both the parties and after keeping in view the mitigating factors, pronounced judgment in which both the accused were convicted for the commission of offence under Section 307 RPC and awarded five years rigorous imprisonment and a fine of Rs 20,000. In case of non-payment of fine, the convict will further undergo imprisonment for the period of three months. However the sentence for non-payment of fine will commence after the expiry of substantive sentence. The fine if collected from the convict should be given to the victim after proper receipt. The period of detention already undergone by the convict is set off. The convict will suffer the sentence in District Jail Kishtwar.
This was only due to the hard work put in by District Police Doda and Court of Additional Session Judge Doda that the conviction of the accused persons became possible vide judgment passed on April 29.
