4 years jail to Pak national

JAMMU, May 10: Principal Sessions Judge Kathua, V C Koul today awarded four years imprisonment and fine of Rs 10,000 to a Pakistan national namely Akhter Hussain, son of Sharief of Narowal.
The Pakistan national was apprehended in injured condition near Border Outpost Paharpur on October 4, 2013 when he was conducting recee of the area to identify possible route for infiltration of group of militants into Indian side.
He was booked under Section 14 Foreigners Act and after completion of investigation Rajbagh Police Station presented challan against him.
After hearing Public Prosecutor Ravi Kumar Gupta for the State whereas Advocate Sunita Devi as Amicus Curie for the accused, Principal Sessions Judge Kathua VC Koul observed, “so far as the evidence on record is concerned, it is established that accused, who is admittedly a Pakistani national, had entered the territory of India after crossing the International Border without any permission or authority. He could also not produce any such permission or authority for entering into Indian territory”.
Accordingly, he was convicted for offence punishable under Section 14 (a) (b) of the Foreigners Act and keeping in view all the facts and circumstances, he was awarded four years imprisonment and directed to pay a fine of Rs 10,000.  “In default of payment of fine, the accused shall further undergo imprisonment for a period of six months”, the Court directed.
