JAMMU, Sept 19: Principal Sessions Judge Kathua, Vinod Chatterji Koul today awarded 31 years rigorous imprisonment to Mohd Mushtaq and Romesh Singh, who were facing trial for the last nine years for dacoity in a temple under the jurisdiction of Basohli Police Station.
After hearing Public Prosecutor BB Sharma for the State whereas Advocates Ganga Ram Sharma and Dharmesh Sharma for the accused persons, Principal Sessions Judge Kathua observed, “prosecution has established/proved the charges against the accused Mohd Mushtaq and Romesh Singh beyond any reasonable doubt”.
“The place where the accused have committed the crime makes it a serious offence, because it has hurt a section of the society having faith in Jourian Mata temple where the people of such faith make offerings”, the court said, adding “the way the offence has been committed requires a punishment so that persons of such criminal mind do not repeat such crimes in future”.
“Keeping in view all the facts and circumstances, the manner in which offence has been committed and the place where from the ornaments and cash were stolen, after posing themselves to be police personnel and while balancing the aggravating and the mitigating circumstances, the accused, who have been found guilty for offences punishable under Sections 170/457/364/392/34 RPC, are sentenced to undergo imprisonment for 31 years”, the court said.
