JAMMU, Oct 10: Presiding Officer Fast Track Court Sanjeev Gupta today awarded three years rigorous imprisonment and fine of Rs 2000 to Ghulam Ahmed, son of Sattar Ahmed of Kossar, tehsil Chenani, who was facing trial for kidnapping of teen-age girl.
The 13-year old girl was kidnapped by the accused on January 14, 2003 and accordingly father of the girl lodged a complaint with the police. After completion of the investigation, police presented challan under Section 363/376 RPC.
After hearing APP GS Charak for the State whereas Advocate Babu Ram Sharma for the accused, Presiding Officer Fast Track Court observed, “prosecution has miserably failed to prove that accused has committed offence under Section 376 but it has proved kidnapping of prosecutrix by the accused”.
Accordingly, accused was convicted under Section 363 RPC (kidnapping of minor) and awarded three years rigorous imprisonment and fine of Rs 2000.
