After hearing both the sides, Principal Sessions Judge Kathua observed, “accused are facing the prosecution since last nine years and both of them are in the prime of their youth. One can imagine the pain and agony they have suffered during all these years while facing the charges”.
“Though the crime committed by them is serious but still keeping in view their age, social status, the date of occurrence etc,  the court believes that there are mitigating circumstances which  weigh  heavily in favour of accused so far as the quantum of punishment is concerned”, Principal Sessions Judge said, adding “a harsher  sentence  would not only affect the accused but would also expose their families to countless miseries”.
While convicting the accused for commission of offence under Section 307 RPC, the Court awarded them three years imprisonment each.
