22 yrs RI awarded in rape case

JAMMU, Jan 12: Principal Sessions Judge Ramban Kishore Kumar today awarded 22 years Rigorous Imprisonment to one Liaqat Ali, son of Ghulam Rubani of Ramban, who was facing trial in rape case.
As per the police case, on 03.12.2011 prosecutrix filed a written report before Superintendent of Police Ramban alleging that Liaqat Ali, son of Ghulam Rubani of Ramban, who was married with her real aunt, had committed rape upon her and thereafter she was conceived and is in pregnancy of 8 months. The complaint was forwarded to Police Station concerned and accordingly case was registered under Sections 376 and 506 RPC.
After hearing both the sides, the Principal Sessions Judge observed, “rape is one of the crimes and social problems that is somewhat regarded as community’s least priority although the victim suffers from grave physical, mental and emotional consequences”, adding “the court has to consider the plight of the victim in a case involving rape and the social stigma that may follow the victim to the grave and which in most cases practically ruins all prospects of a normal life for the victim”.
“The court has to do justice to the society and to the victim on the one hand and to the offender on the other. It is the duty of the court in every case to award a proper sentence having regard to the nature of the offence”, the Judge said, adding “the offence committed in the present case is kidnapping, wrongful confinement and rape of the victim. Such like crimes are affront to the human dignity. The crime is not only against the victim and her family but it is against the whole society as well”.
With these observations, the court awarded Rigorous Imprisonment of 22 years to Liaqat Ali and imposed a fine of Rs 50,000 for the offence under Section 376 RPC and 2 years imprisonment under Section 506 RPC. “In default of payment of fine, he shall further undergo simple imprisonment for six months. The fine, if deposited by the accused, shall be paid to the prosecutrix”, the court said.
Stating that the victim has passed a very hard period after the commission of rape and she has also faced mental trauma and has to face till her natural life in the society for the none of her fault and crime, the court directed that Rs 2 lakh which shall be paid by the Government under the provisions of Victim Compensation Scheme to the victim.
